Walsh is defended by Andrea Lyon, a prominent attorney known for her work on Casey Anthony’s team. Lyon argues Walsh’s actions were driven by mental illness. She states, ‘This is a tragedy for the Walsh family, all of whom are mourning the loss of this child. It is also a tragedy in that Corie herself was experiencing a psychotic episode.’
Illinois defines insanity based on the inability to appreciate the criminality of one’s conduct due to mental defects. Richard S. Kling, a law professor at Chicago-Kent College of Law, clarifies that a psychiatric diagnosis alone doesn’t meet the legal standard for insanity. He notes that defendants must prove they were legally insane during the offense.
Walsh’s defense also highlights her struggle with mental health care in custody. After her arrest, she underwent treatment for self-inflicted wounds with medical professionals recommending round-the-clock psychiatric care. Evidence of planning or concealment of the crime strengthens the prosecution’s argument, suggesting awareness of the criminality involved. Walsh reportedly told police she believed her son was the ‘devil’ and referenced the case of Lindsay Clancy, a Massachusetts woman facing similar charges.
Kling emphasizes documenting mental illness history, treatment, and medication is crucial in such cases. Psychiatrists assess mental states before and after alleged crimes to understand the condition at the time of the offense.

The murder charges she faces could lead to a severe prison sentence. Each first-degree murder count carries a potential 60 to 100-year term. Such a sentence requires 100% completion upon conviction due to the victim’s age.
