Judge Blocks Subpoena for Transgender Youth Medical Records

A federal judge in Manhattan has issued a ruling to stop the Justice Department from seeking sensitive medical information about transgender youth who received transition-related care at hospitals in New York City. This decision comes amidst the Trump administration’s efforts to halt gender transition treatments for adolescents, citing potential harm to young individuals.
For over a year, the Justice Department had been investigating medical providers that offered gender transition care to youth, posing a significant challenge to its inquiry. Judge Katherine Polk Failla of the Federal District Court made her ruling during a conference call with attorneys.
Judge Failla expressed concerns over the grand jury subpoena issued to NYU Langone, a prominent medical system, which sought identifying information and medical records of adolescent patients who accessed transition care over the past six years. These patients, according to the judge, pursued gender-affirming treatments under the assumption of complete privacy.
“Because I cannot conceive of a crime that would require the breadth of disclosure sought in the subpoena — sensitive medical information for an entire class of people for a six-year period — I have to find that the government’s interest does not outweigh the plaintiffs’ interest in privacy,” stated Judge Failla.
Judge Failla warned of severe consequences if she did not intervene. She emphasized the harmful impact of allowing the subpoena to proceed, which would lead to the government obtaining and potentially disclosing intimate details of the plaintiffs’ medical histories and personal lives, particularly regarding their transgender status.
