The possibility of a plea deal is being discussed following a mistrial in the Lindsay Clancy murder case. Criminal defense attorney Donna Rotunno shared her views on the case during an appearance on ‘Fox & Friends Weekend.’ Debate continues over whether a plea agreement could resolve the charges against Clancy after the death of her three children.
On Tuesday, Clancy’s attorney, Kevin Reddington, expressed openness to a plea deal. He hopes the district attorney will revisit the case, which ended in a mistrial after jurors couldn’t reach a unanimous verdict, reportedly with an 11-1 split. Reddington argued the dissenting juror held doubt yet failed to apply the judge’s guidance on reasonable doubt properly.
Lindsay Clancy, 36, faced three counts of first-degree murder for the deaths of her children—Cora, Dawson, and Callan, all under six—found strangled at home in January 2023. In an interview with ‘Good Morning America,’ Reddington stated he hopes to negotiate with Plymouth County District Attorney Tim Cruz, whom he’s known for 30 years.
“I‘m willing to listen to Tim. I hope after seeing the evidence presented, a resolution acceptable to both sides can be found,” Reddington explained.
Previously, Reddington noted that prosecutors were not open to a plea during talks with reporters. He also mentioned a readiness for a retrial, indicating there was no plea bargaining from Cruz, who seeks triple homicide convictions.
In a separate appeal, Reddington asked President Donald Trump to consider pardoning Clancy, although the trial is in state court and not under federal jurisdiction.
Reddington softened criticism toward the holdout juror, acknowledging respect for the judicial system’s allowance of dissenting opinions.
Patrick Clancy, the children’s father, through his attorney Howard Cooper, condemned a defamation campaign targeting the family. Cooper warned of legal actions against those spreading false claims linking Patrick Clancy to his children’s deaths, emphasizing the damage this misinformation has caused.
The next steps for Lindsay Clancy’s case are unclear as the district attorney has not revealed his plans. A status hearing is scheduled for September 29.
