In 2023, a train derailment in East Palestine, Ohio led to exposure concerns due to burning vinyl chloride. Renowned exposure expert Stephen Petty tested the soil and water on behalf of class-action attorneys. Despite negotiating a $600 million settlement with Norfolk Southern, the attorneys did not release Petty’s test results, even to their own clients.
Contamination Revealed
NewsNation received these hidden results and interviewed Petty. He stated that carcinogens are present in the soil above screening levels, requiring further actions. His data indicated elevated levels of dioxins and PAHs, potent carcinogens.
The levels exceed cancer-screening levels set by the EPA, requiring additional testing and analysis.
Petty highlighted that 50% to 70% of data points concerning dioxins and PAHs surpassed EPA screening levels for cancer.
Independent Testing and Suppression
Scott Smith, an independent expert, also found high dioxin levels. Both Petty and Smith, supported by the Government Accountability Project, claimed data suppression. Smith noted a 49% excess in EPA cancer screening levels, aligning with Petty’s findings.
Residents React
Residents described discrepancies between Petty’s findings and attorney reports in the class-action lawsuit. Beth Kosar mentioned secrecy surrounding Petty’s results, fearing damage to the case.
Linda Murphy shared audio where attorneys downplayed contamination levels, suggesting the settlement impact could diminish if data were released. They discouraged Petty’s data citing non-aggravating health risks.

Attorney Mindy Bish represents residents seeking to withdraw from the settlement, challenging Carson’s statements and revealing developing cancer cases weekly. She stated attorneys misrepresented Petty’s data.
Residents filed a motion alleging fraud and data concealment to retract personal injury release agreements. Despite initial denial, they continue appealing for reopening the case.
Druckenbrod admitted feelings of manipulation, aiming to substantiate claims against alleged deceit.
