States Challenge Education Access for Undocumented Children

Various states are questioning the established rule that allows undocumented children to attend public schools without charge. This challenges a practice upheld since 1982.

In 1982, the U.S. Supreme Court decided in Plyler v. Doe that immigrant students in Texas had the right to attend school free of charge. This decision overturned a 1975 Texas law permitting public schools to either charge tuition to these students or deny them access.

All public schools across the U.S. are mandated to provide education to all students, regardless of their immigration status. This ensures that every child, regardless of their citizenship, has access to education.
