Arkansas Judge Dismisses Murder Charges Against Sheriff Candidate

An Arkansas judge has dismissed murder charges against Aaron Spencer, a local candidate for sheriff and an Army veteran. Spencer was accused of fatally shooting 67-year-old Michael Fosler, who allegedly assaulted Spencer’s teenage daughter.
Originally, Spencer faced charges of second-degree murder for the incident in Lonoke County in October 2024. Court records reveal that Special Circuit Court Judge Ralph Wilson Jr. dismissed these charges citing issues with evidence handling.
The prosecution alleged that Spencer found Fosler with his daughter in Fosler’s pickup truck during the early hours of October 8, 2024. Allegedly, Spencer then forced Fosler’s vehicle off the road and called 911, admitting to the shooting.
The judge highlighted significant issues with law enforcement’s handling of evidence, particularly the loss of dash-camera footage and an SD card from Spencer’s truck. Judge Wilson stated that this mishandling warranted the dismissal of the case, describing the law enforcement conduct as “egregious.”
“The loss or destruction of the internal SD memory card of the dash camera has adversely impaired the Defendant’s ability to defend himself,” the judge noted.
Spencer’s defense argued that the lost SD card potentially contained crucial evidence and that its absence deprived Spencer of a fair trial. He had, however, admitted to the shooting while pleading not guilty to the charges.
Fosler had faced various sexual offense charges involving Spencer’s daughter and was released on bond when the shooting occurred. Spencer later won the Republican primary for Lonoke County sheriff, stating his intent to reform the local law enforcement agency.
Spencer expressed discontent with existing legal and law enforcement systems, highlighting his determination to drive changes based on his experiences.
The Lonoke County District Attorney’s Office has not decided on any new charges following the case dismissal. Details about the impact of this legal outcome on Spencer’s candidacy remain unclear.
