Kentucky’s legislation in 2024 removed the governor’s power to appoint a replacement senator, instead mandating a special election to fill any vacancy. This change affects any vacancy before McConnell’s term ends in January 2027.
McConnell’s office and Kentucky’s Secretary of State were contacted by Newsweek for comments on the situation.
Mitch McConnell’s Health Update
Concerns surround McConnell’s health following a hospitalization. His office has shared limited details but confirmed he is recovering. They stated, “Senator McConnell appreciates the support while continuing his recovery in the hospital. He is improving and working with his staff on matters related to Kentucky and the Senate.” This assurance came as he remains a serving U.S. senator.
Elaine Chao’s Visit to China
While McConnell received medical care, discussions online highlighted his wife Elaine Chao’s visit to China. Reports from Chinese sources showed Chao in meetings shortly after McConnell’s medical issue.
Images showed Chao meeting with Chinese Vice President Han Zheng, encouraging stronger China-U.S. ties. Newsweek sought Chao’s comments but received no immediate response.
Kentucky’s 2024 Senate Succession Law
House Bill 622, passed in 2024, marked a major shift by repealing KRS 63.200. This bill set out a special election system to fill Senate vacancies, requiring the governor to proclaim an election. The winner would serve the unexpired term.
This law removed the governor’s authority to appoint a temporary senator, differing from most states’ succession models.
Legal Ambiguities
While the law outlines a special election process, some details remain unclear. For example, it does not specify how a vacancy late in an election year coincides with an ongoing Senate race.
Given McConnell’s seat is contested in the 2026 election, voters would elect a new senator in November irrespective of McConnell completing his term.
The law clarifies there is no gubernatorial appointment, but ambiguity exists on handling a vacancy late in the senator’s term.
McConnell’s Unique Situation
McConnell’s announced retirement highlights the issue is less about his replacement and more about pre-2027 vacancy procedures under Kentucky’s new law.
Though McConnell remains a sitting senator, the revised law is untested in real Senate vacancies.
Following his announcement to step down as Senate Republican leader, Senators John Thune, John Barrasso, and John Cornyn emerged as potential successors, collectively known as the ‘three Johns.’
