Former FBI Director James Comey has strongly denied allegations that he communicated national defense information inappropriately, labeling the Justice Department’s recent actions as an ‘appalling abuse.’ The accusations stem from a purported disclosure in 2016, and Comey asserts his innocence. He plans to contest the allegations vigorously.
The Justice Department has officially charged Comey, submitting a criminal information in U.S. District Court for the District of Columbia. The two-count filing claims Comey shared sensitive national defense information and participated in a conspiracy to unlawfully disclose it. According to a DOJ spokesperson, the filing is primarily to ensure the allegations remain viable before the statute of limitations expires, as investigations continue.
A spokesperson stated, ‘The Department filed a waiverless criminal information to toll the statute of limitations regarding allegations concerning former FBI Director Comey.’ This method is recognized by federal courts and supported by Circuit Courts of Appeals, emphasizing the ongoing nature of this criminal investigation.
Comey’s legal representatives challenge the filing, insisting that an indictment from a federal grand jury should precede any further legal action. U.S. District Judge Trevor McFadden convened an emergency, private hearing on October 9. During the hearing, which followed Comey’s attorneys’ motion to dismiss the case and unseal proceedings, McFadden agreed to unseal the case but has not yet decided on the dismissal motion.
Prosecutors report that on October 5, 2016, Comey allegedly shared national defense information with someone unauthorized to receive it. Comey, via his Instagram post, has fervently denied these claims, stating, ‘Nothing’s changed with me. I’m still innocent. I’m not afraid of these people. And I still believe in the independent federal judiciary.’
He reaffirmed his commitment to resisting these allegations alongside his family and legal team, expressing they would confront any future proceedings.
This case represents the Justice Department’s third attempt to prosecute Comey under President Donald Trump’s administration. Previous charges, including lying to Congress, were dismissed. Meanwhile, another charge related to a social media post labeled ’86 47′ remains unresolved.
