Italy has agreed to the partial extradition of Texas murder suspect Lee Gilley after extended discussions with U.S. courts, according to Fox News Digital. Gilley is accused of murdering his pregnant wife, Christa Bauer Gilley, along with their unborn child in 2024. Although he was due to stand trial in Harris County earlier this year, he evaded authorities by cutting off his ankle monitor and fleeing the United States to Italy. Reports indicate that he left home on a bicycle before taking a private jet from Memphis, Tennessee, suggesting he had assistance in escaping.
A motion obtained by Fox News Digital, translated from Italian, confirms that Italy granted extradition, but solely for one charge of murder, specifically not for capital murder. Authorities found Christa Bauer Gilley deceased in her Houston home while she was pregnant. Prosecutors allege that her husband, Lee Gilley, was responsible for her death.
Christa Bauer Gilley’s parents demand Lee Gilley’s return to the U.S. for the murder trial.
The Italian court’s motion specifies that extradition is contingent upon Gilley facing a charge of first-degree murder for his wife’s death, excluding the unborn child. Previously, Italy denied extradition requests due to concerns over the potential for Gilley to face capital murder charges with penalties such as the death penalty or life without parole.
If convicted under the reduced charge, Gilley could face a sentence ranging from 5 to 99 years in prison, as per Texas law. However, this is not a guarantee of his return to U.S. soil. Gilley’s defense attorney, Dick DeGuerin, stated that the defense plans to appeal the decision in the upcoming days.
This decision by the Italian courts may prolong the process of extraditing the suspect back to the U.S. Gilley’s attorney did not specify an exact timeline for his client’s potential return.
